Currently married couples must either use adultery or unreasonable behaviour if they wish to divorce in the first two years of separation. Otherwise they must wait two years and have the consent of their spouse or wait five years if their spouse does not consent to the divorce.
Justice Secretary David Gauke has recently announced plans to introduce no fault divorce. Ministers are seeking to reduce the antagonism of fault-based divorces at an already trying time for families. A new notification process will allow people to notify the court of the intent to divorce, whilst removing the opportunity for the other spouse to contest it.
