A recent survey has revealed that 7 in 10 separating couples do not consider their pensions during divorce proceedings; this is despite the average household pension pot having a value of over £130,000.
Separating couples have financial claims against each other in respect of their income, capital and pensions. The starting position of the Court when dealing with a separating couple’s finances is to consider all of the assets of each of the parties (including pensions) and to divide these equally.
Whilst there are a number of considerations the Court will take into account when deciding if an equal division is fair, what this recent survey shows is that many individuals going through divorce can be left short changed by not giving consideration to their spouse’s pension.
This may leave individuals in a vulnerable position upon retirement.
