The number of cohabiting couples (i.e. unmarried couples living together) has
increased significantly over recent years. Despite this increase, there remains an
urban myth that couples who live together have similar rights to those who are
married under what has been referred to as a “Common Law Marriage”.
In reality, there is no such thing as a Common Law Marriage. Cohabiting couples do
not have the financial claims against each other’s capital (including any properties),
pension and income in the same way that married couples do.
In some cases, this can leave individuals in a very vulnerable financial position upon
separation from a partner they have lived with but were not married to.
