As England enters its second lockdown, being required to spend additional time at home may be placing an increasing pressure on some couples and families. Add to that possible financial strains, employment worries and differing approaches to the virus’ risk and it is easy to see how a second lockdown may have a negative impact upon some relationships.
In contrast, there may for some be many benefits of a second lockdown to family life and it is also important to reflect upon these, less social pressure and more time together could have a real positive impact for some families.
Sadly, the impact of a second lockdown may be extremely concerning for anyone living in an abusive relationship. The Government made clear at the beginning of the first lockdown in March that there was an exemption to the ‘stay at home’ rule for any victims of domestic abuse who needed to leave the home to seek refuge.
There are injunctions available within the Family Law Act 1996 that can offer protection to the victims of domestic violence. These include Occupation Orders which may prevent a perpetrator from returning to the family home or Non Molestation Orders which can prohibit the perpetrator from using or threatening violence against the victim.
