Senior Judicial figures have condemned 50-year-old divorce laws as no longer fit for purpose. Leading Judges have highlighted how the current laws, which require divorcing couples to place fault or blame on the other party in order to end their marriage without the need to wait at least two years, intensify animosity and hostility.
Heightened animosity between separating couples can have lasting negative effects upon any children of the marriage and can make it difficult to have a positive co-parenting relationship for the benefit of the children post separation.
Divorce is difficult enough. The need to assign blame can make it harder for separating couples to reach agreements amicably.
These recent comments come after a long line of other senior figures and Lawyers have urged the Government to consider reform in order to modernise the current laws and make them fit for use in today’s society.
MP, Suella Fernandes, lead a debate in Westminster on Wednesday 15th November to discuss the need for reform in family justice including the introduction of no fault divorce. The briefing paper following Wednesday’s debate is awaited.
