The respondent to a divorce application must complete the acknowledgement of service form which confirms that the petition has been received and gives the respondent the opportunity to defend proceedings or comment on the contents of the petition if they wish.
If however the respondent fails to complete the acknowledgement of service, a solicitor can instruct a process server on your behalf to personally serve the divorce documents on your spouse. The server will then provide a witness statement to the court confirming that successful service has taken place.
Once the document has been formally served, subject to the judge’s discretion, divorce proceedings can then progress to the Decree Nisi stage without further input from your spouse.
