If you and your spouse can agree the arrangements for your children when you get
divorced, then no one else needs to get involved. The court does not need to
sanction your agreement because you are expected, as parents, to act in the best
interests of your children.
If you cannot reach agreement then mediation can be helpful in some cases and,
apart from in exceptional cases for example if the children are being put at risk by
the actions of the other parent, a consultation with a mediator must take place before
court proceedings are issued.
If you cannot reach agreement and mediation fails or isn’t appropriate, then court
proceedings can be issued. The court will then look into the case and decide what
the arrangements should be.
