A Consent Order reflects the terms of a financial agreement reached between separating spouses. The Order is agreed and signed by both parties and forwarded to the Court for the Court’s approval.
Once approved by the Court the agreement is legally binding and enforceable and provides each party with certainty and security as to their future financial positions. It is only by obtaining a Consent Order that the financial claims that each party has against the other in respect of pensions, income and capital can be dismissed, either immediately or at a specified date in the future. This helps to protect each parties’ future financial positions.
The financial claims that parties have against each other by virtue of their marriage or civil partnership do not automatically end once their divorce is complete; instead the parties need to prepare a Consent Order to help protect their financial positions once the marriage has come to an end.
George Green’s Specialist Family and Divorce Lawyers regularly advise clients in respect of the financial aspects arising from the breakdown of a marriage and the benefits of preparing Consent Orders.
