Family Law
Separation and divorce can be a stressful time and the process itself may seem daunting or overwhelming at the outset. For many people, they will not have been through the process before and so the steps needed are all new and unknown.
At George Green our specialist family lawyers advise clients in an approachable and straight forward manner to help alleviate any stresses and to help make the process less overwhelming.
Our family solicitors will advise on the potential pitfalls or mistakes that clients could make that may result in them not best protecting their position. An example of some of the key mistakes that our family lawyers see clients make whilst getting divorced are as follows:
Not getting a financial order
There is a misconception that financial claims that spouses have in respect of the other automatically come to an end once the Decree Absolute has been granted. This is not the case, any agreement regarding financial matters should instead be reflected in a financial order and this should formally dismiss any future claims.
Remarrying before financial matters have been resolved
Remarrying before a financial order has been put in place with a former spouse may prevent the individual from bringing financial claims against their former spouse.
Disregarding pension assets
Pension assets may make up a substantial part of a separating couples finances and to disregard these could leave one party in a seriously disadvantaged position.
Our family solicitors will always advise clients on how to best protect their positions during divorce proceedings and whilst dealing with financial matters arising from their separation.
