Can I Get Divorced?

Divorce and separation FAQs

A spouse can start divorce proceedings in England and Wales if they can satisfy the following two requirements:

 

  1. They have been married for more than a year; and

 

  1. Their marriage has permanently broken down.

 

       To show that a marriage has permanently broken down a Petitioner must rely on one of the following five facts:

 

  1. The Respondent’s adultery;

 

  1. The Respondent’s unreasonable behaviour;

 

  1. Desertion;

 

  1. Two years separation with the Respondent’s consent; or

 

  1. Five years separation without the Respondent’s consent.

 

If the above are satisfied, the Petitioner will need their original marriage certificate which must be sent to the Court alongside their petition.
