The workshop will examine the recent ACAS guide on conducting workplace investigations, the 2009 code of practice on disciplinary and grievance procedures and the 2014 guide to discipline and grievances at work.
The session will deal with frequently asked questions such as:
● Who should carry out the investigation?
● Is the employee entitled to be accompanied at an investigation meeting?
● What if a witness refuses to cooperate?
● What if a witness wants to remain anonymous?
● What if there are no other witnesses and it is just one person’s word against another?
● How extensive does my investigation have to be?
● How should I set out my investigation report and conclusions?
● Can I record interviews?
● What happens if the police are involved?
The workshop will then conclude with the delegates working through a number of case studies based on case law including the 2015 case of Ramphal v The Department of Transport which dealt with the extent to which HR can permissibly get involved with investigations being conducted by other managers.
